Viaan Ventures (registered legal entity, also known as Digitize Studio, our digital arm) operates MarkOS, an AI-powered marketing automation platform. References to "we", "us", or "our" mean Viaan Ventures.
1. Acceptance of Terms
By accessing or using MarkOS, you agree to be bound by these Terms & Conditions and all applicable laws and regulations. If you do not agree with any part of these terms, you must discontinue use of the platform immediately. Continued use of MarkOS after any update to these terms constitutes acceptance of the revised terms.
2. Description of Service
MarkOS is an AI-powered marketing automation platform owned and operated by Viaan Ventures and marketed under the Digitize Studio brand. The platform enables businesses to generate, schedule, and publish marketing content across social media channels, manage leads, and automate customer communications. Features and pricing tiers are subject to change with reasonable notice.
3. AI Content Disclaimer
Content generated by MarkOS is produced by third-party AI models, including Claude by Anthropic (text and copy) and DALL-E by OpenAI (images). AI-generated content may contain factual inaccuracies, outdated information, or copy that does not align with your brand tone. You are responsible for reviewing all AI-generated content before it is published. Viaan Ventures does not warrant the accuracy, completeness, or suitability of any AI-generated output.
4. Content Moderation Responsibility
You are solely responsible for reviewing and approving all AI-generated content prior to publication on any platform, including Instagram, Facebook, WhatsApp, LinkedIn, and Google Business. Enabling auto-publish features means you have accepted responsibility for the content that goes live. We strongly recommend configuring a human review step in your publishing workflow for any sensitive, regulated, or time-critical communications.
5. Prohibited Uses
You may not use MarkOS to generate, publish, or distribute content that is misleading, defamatory, discriminatory, illegal, sexually explicit, hateful, or that infringes upon the intellectual property rights of any third party. You may not use the platform to send unsolicited commercial messages (spam), to impersonate another person or organisation, or to circumvent the content moderation policies of any connected social platform. Violations may result in immediate account suspension.
6. Third-Party APIs
MarkOS integrates with APIs provided by Meta Platforms (Instagram, Facebook, WhatsApp), Google (Google Business Profile, Google Analytics), X (Twitter), Shopify, GitHub and LinkedIn. Your use of these integrations is also governed by the respective terms of service and developer policies of those platforms. Viaan Ventures is not responsible for disruptions, policy changes, or account actions taken by third-party platforms in relation to content published through MarkOS.
7. Payment & Billing
Subscriptions are billed on a monthly or annual cycle in Indian Rupees (INR). All prices are exclusive of applicable GST unless explicitly stated otherwise. Subscriptions renew automatically at the end of each billing cycle; you may cancel at any time from your account dashboard to prevent the next renewal. Refunds are not provided for partial billing periods. In the event of a billing dispute, contact connect@digitize.studio within 14 days of the charge.
8. Account Termination
You may cancel your account at any time through your account settings or by emailing connect@digitize.studio. Upon cancellation, your access to paid features ends at the close of the current billing period. Viaan Ventures reserves the right to suspend or terminate accounts that violate these Terms, with or without prior notice depending on the severity of the violation. Personal data and OAuth tokens associated with terminated accounts are handled as described in our Privacy Policy; some records, such as billing or backup data, may be retained for up to 90 days for legal and operational purposes before permanent deletion.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Viaan Ventures shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, or reputational harm arising from the use of MarkOS or from AI-generated content published by users. In any event, Viaan Ventures' aggregate liability to you shall not exceed the total subscription fees paid by you in the three months immediately preceding the claim.
10. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the competent courts in Mumbai or Bengaluru, India, at the discretion of Viaan Ventures.
